1. Descriptions, Estimates, Authenticity & Fitness for Purpose
Descriptions, Accurate descriptions and photographs are provided for each individual item in the auction on a best effort basis and are not intended to be definitive scholarly works or appraisals.
Authenticity. Autographs, Firearms, Precious metals, Coins and Gems in single item lots are guaranteed authentic. A full refund of the purchase price and buyers premium shall be the limit of liability of the auction company and or its representatives should a lot be deemed not authentic. Returns must be preauthorized and made within 10 days. All guarantees are void if an item has been tampered with, enhanced, altered, damaged or removed from original mounting. You understand by bidding that the property you bid on is not represented by us to meet a specific purpose of yours and as such is not a consumer transaction.
Lots of MORE THAN A SINGLE ITEM of any product are intended as “dealer” lot and are sold as is, where is, and the ultimate determination is the responsibility of the bidder. The placing of a bid will be taken as full agreement to all terms & conditions.
Estimates. The estimated values shown are preliminary anticipations of what lots are likely to realize. While we tend not to accept items from consignors with “reserves”, we must satisfy Florida state law by declaring that any and all items in this sale either are or may be subject to reserve. In the instance that a reserve does exist, it will not be greater than the low estimate.
2. Pre-bids Pre-bidding is used by those who cannot attend our auction. These bids can be made at the location or via. Our web site, mail, or by telephone.
The pre-bidder must determine the maximum offer for each lot desired. A trained professional will bid on your behalf. The pre-bidder will bid in increments leading up to your maximum amount bid, and not necessarily your highest bid. For example, your bid is $110 and the next highest bid on the floor is $80 - your hammer price is $85.
In the event of a tie bid between a floor and absentee bidder, the floor bidder will prevail.
Lots purchased on behalf of absentee bidders will be forwarded by the most practical method at the risk of the purchaser. Postage, packing, freight and insurance costs or part thereof shall be borne by the purchaser. A 13% Buyer’s Premium applies to all absentee bids.
3. Telephone bids: Telephone bids must be arranged prior to the date of the auction. We do not accept any responsibility for errors made in taking bids, especially by telephone, every effort is made to ensure accuracy. 4. Floor bids: Floor bidders must register and obtain a bidding number on arrival. If successful in obtaining a lot, please ensure that you display your bidding number clearly to the auctioneer and that it is your number that is called out. If you have any doubt about the price or buyer , please draw this to the auctioneers attention immediately.
Starting prices are determined by the auctioneer at time of the sale.
Room bidders must settle their invoices on the day of sale. You may pay for and collect your purchases at any time during the sale. Items must be picked up the day of the auction. Any item left over after the auction will be transported back to out gallery and shipping & handling fees will be added to your total. Payment may be made by cash or check that is supported by a valid banker's card (up to card maximum). We also accept credit cards MC, VISA, AMEX.
Employees and associates of the auctioneer's are permitted to purchase lots at competitive bidding under the same terms, rules and regulations as the general public.
We must ask all room bidders to please avoid distracting the auctioneer and the clerk during the auction. Both the auctioneer and clerk are not available to answer any questions about consignment, lots, prices, pre-bidding, or any other matter during the auction. Please refer all questions to other employees of Affiliated Coins, Antiques, and Auctions.
A 13% Buyer’s Premium applies to all floor bids. The Buyer Premium is discounted to 10% if paying by cash or check.
5. Identification – All purchasers are required to complete the registration and obtain a bidder number. All registration cards contain Full Name, Address, Phone, Email, and Drivers License Number. Those not willing to disclose this information cannot partake in the auction. No sharing of bidding numbers allowed.
6. Auctioneer: The bidding advances shall be regulated by the auctioneer and shall be at his discretion. He has the right to refuse any bids. The auctioneer reserves the right to bid on behalf of clients and vendors, but shall not be liable for errors or omissions in executing instructions to bid. The auctioneer act as agent only, and shall not be liable for any default of the purchaser or vendor.
7. Payment - Florida residents will be charged 7.5% sales tax on all applicable purchases unless a current year tax exempt certificate is presented prior to the sale. We accept cash, money order, cashier's check, personal check, Visa, MasterCard, Discover and AMEX. We reserve the right to verify funds on personal checks. A $30 fee will apply to all returned checks. The full purchase price on all lots sold to the same buyer must be paid before removal of any of the items. Payment in Full is due by the 7th day following the auction. Unpaid lots are deemed “Unsold” and returned to inventory on the 8th day following the auction. A $30 per day Storage Fee applies to all large items left beyond the 15th day following the auction.
8. Dispute – If any dispute arises between two or more bidders, the auctioneer may decide the same, or may immediately put the lot up for sale again, and resell to the highest bidder. The decision of the auctioneer shall be final and absolute.
9. Consignors - These terms and conditions can be discussed with any of our employees during the normal business week.
Consignors are NOT permitted to bid on their own items. This is called "shill bidding" and is illegal by Florida Auction Law standards. By placing your item up for auction, you have agreed to sell.
All consignors are paid on the 15 & 30th day after the auction provided we have received payment from the buyer. We cannot discuss payment on the day of the auction.
