Broker Participation:
A two percent (2%) commission on the high bid price / hammer price (before
inclusion of the Buyer Premium) on the real estate will be paid to any properly
registered broker whose prospect purchases real estate at the auction and
closes in full. Brokers must be licensed in the State of Florida and must register and attend the
auction with their prospect. Broker MUST register via the applicable
"Broker / Agent Cooperation Agreement" no less than 24 hours prior to
auction start time. The "Broker / Agent Cooperation Agreement" MUST
accompany this bidder (client's) registration.
Terms:
Successful bidders will make a non-refundable deposit of 10% of the purchase
price at the auction in the form of cash, cashier's check, personal or company
check with a bank letter of guarantee (as indicated below), sign a real estate
sales contract with the balance at the closing. 10% Buyer's Premium
Added! Example: Hammer price $150,000 plus 10% Buyer's Premium =
$165,000 (Purchase Price). Deposit = $16,500 due day of sale.
Closings: All real estate transactions must close
within 30 days of auction day. All closings will take place with the firm

Prorations: All taxes from the current year shall be prorated as of
date of closing
Buyer shall pay for the following: All closing costs (except
documentary stamps on Deed), including title insurance, recording fees, survey
and any other necessary costs / fees.
Title: Seller will deliver Title free of liens or
judgments. Affiliated Auctions & Realty has not conducted a title search on
this property. If title is defective and cannot be made good within 60 (sixty)
calendar days after the Seller being notified in writing of the specific
defects, the Buyer may choose to render the contract null & void, and have
their deposit refunded.
Bank Letter Of Guarantee:
All bidders must provide a valid Bank Letter Of Guarantee in order to bid.
Sample Guarantee Letter:
As a customer of _________ bank, we will
guarantee payment of checks drawn on account #__________ not to exceed the
aggregate amount of $___________ for purchases at the auctions of Affiliated
Auctions & Realty LLC on _________, 200_ in _________ county,
FL.
Property is sold and conveyed
“As Is” “Where Is” with any and all faults: Neither the auctioneer, Affiliated Auctions & Realty
LLC., the Seller or their agent make any guarantees, representation or
warranties, expressed or implied, as to the condition, fitness, particular
purpose, merchantability, matters of survey, quality, habitability, design or
environmental status of the property. It is assumed by All that, by agreeing to
these terms, the bidder has completed any and all preliminary property
inspections in preparation for bidding. In bidding the bidder is relying solely
on their own expertise and information.
Agency Disclosure:
In all transactions, the auctioneer is acting as an agent for the seller, not
as buyer's agent.
Registered Bidders:
At least 5 bidders must be registered for the auction or the seller reserves
the right to cancel the auction.
